SEATTLE —President Donald Trump and leaders in Oregon are stillawaiting a court decision about whether Trump can move forwardwith his deployment National Guard troops to an ICE facility in Portland.
“It’s certainly unusual in our contemporary setting,” Associate Teaching Professor of Political Science at Seattle University Patrick Schoettmer said.
Schoettmer said, generally, presidents coordinate with governors, who are usually heads of their state’s National Guards, in deciding whether to mobilize them in their own state or others.
“Seeing a president using the national guard over the heads of the governor, to do things that the local governments are explicitly opposed to, challenges this historical basis that power is supposed to flow from the bottom up,” he said.
The question that remains, and is being hashed out in the courts, is whether Trump is acting within his legal rights as president.
As long as the president is deploying the national guard units to defend federal property, or other things like that, it is okay, Schoettmer said, “I think he’s towing just up to the line, but not crossing it yet.”
The courts stand to play a large role in this battle, accoridng to Schoettmer most Americans think presidents should be deferential to the courts, and with a midterm election coming up, trust and satisfaction within a party is crucial.
“The president seems comfortable ignoring state preferences in a number of cases, but he doesn’t necessarily ignore courts in the same way,” Schoettmer said.
This has not happened yet – but Trump has talked about invoking the rarely used Insurrection Act, which would empower him to deploy the U.S. military nationally and federalize the National Guard for law enforcement purposes.Meanwhile, in Seattle, city officials arepreparing for a possible deploymentback here at home; during the week, Mayor Bruce Harrell signed two executive orders to be ready in the case that Trump takes similar action in Seattle.
